About Us
Our Business Recovery and Insolvency team has been providing specialist recovery and insolvency services throughout NSW and interstate for over 25 years. We now have expanded our reach to include a national capability through the Lawler National Alliance of independent firms, that includes nine appointees and over 70 dedicated insolvency staff.
We aim to provide stakeholders with value, service and a personal approach and are able to deliver a full range of formal and informal business recovery and insolvency services. Through the use of industry specific technology and appropriately structured teams, we are able to offer creative solutions that explore all possible options and in some cases may result in the survival of a business.
Our experience includes acting for both debtor based and creditor based assignments and we have developed valuable relationships with regulators, financiers and across various business sectors that allows us to achieve positive outcomes for our clients.
Our People
The Business Recovery and Insolvency Team is staffed by personnel who have had extensive experience in client advice together with a commensurate ability to expediently diagnose situations and their causes. All staff are able to effectively identify and implement the most appropriate corrective course of action.
It is also an objective of the team to, when possible, return all businesses to profitable operation through arrangement and re-organisation of the business.
Our Approach
Services most often provided by the Business Recovery and Insolvency team in the area of reconstruction are:
- Meeting/negotiating with financiers and reorganising (and minimising) the cash outflow in respect of debt servicing.
- Arranging and meeting with creditors on both formal and an informal basis to arrange "work out" programs whereby supply of essential products is continued while past debts are extinguished over an extended period of time.
- Meeting with directors and/or shareholders, (and other family members where appropriate) to explain to them the current situation, the ramifications and their rights and obligations given the circumstances the business currently faces. This also includes advising the directors (and shareholders) of their responsibility under the Corporations Act.
- Undertaking the preparation of business recovery plans.
- Undertaking a review of the organisations structure.
- Being available on a day-to-day basis so as to ensure all problems encountered are addressed and dealt with on a timely basis.
By adopting this approach we believe that we are able to be compassionate and understanding while at the same time assist in making those hard decisions which are essential in dealing with a potentially insolvent business.
Unfortunately not all businesses can be returned to profitable trading. In these instances some form of insolvency arrangement must be instigated to protect not only creditors, employees and shareholders but also the directors.
